These General Terms and Conditions of Sale (hereinafter the “GTC”) apply to all sales concluded on the website frenchyshapes.com.

Article 2: Purpose and Acceptance of the GTC

The purpose of these GTC is to define the contractual relationship between FrenchyShapes and the buyer (hereinafter the “Customer”), as well as the conditions applicable to any purchase made on the website. The acquisition of a product through this website implies unconditional acceptance by the Customer of these GTC. FrenchyShapes reserves the right to modify its GTC at any time. The applicable conditions are those in force on the date the order is placed by the Customer.

Article 3: Products

The products offered are those listed on the FrenchyShapes website, subject to stock availability. Each product is presented with a description detailing its main technical characteristics (dimensions, material, color, etc.). The photographs are as accurate as possible but do not bind the Seller in any way should there be variations (particularly concerning color due to screen display).

Article 4: Prices

The prices indicated on the product pages are in Euros (€) inclusive of all taxes (VAT included). FrenchyShapes reserves the right to modify its prices at any time; however, the product will be invoiced based on the rate in force at the time of order validation. Prices do not include delivery costs, which are billed additionally and specified prior to final order validation.

Article 5: Orders

The Customer places an order on the website. For the order to be validated, the Customer must:
Add the product(s) to their cart.
Validate their cart and complete the delivery and billing information.
Accept these GTC by checking the designated box.
Choose their payment method and proceed to payment. Any confirmed order constitutes acceptance of the prices and descriptions of the products available for sale. FrenchyShapes will send an email confirming the registered order.

Article 6: Payment Terms

Payment is due immediately upon ordering. The Customer may pay for their order using the following methods:
Credit/Debit Card: Payments by bank card are processed through a secure system [e.g., Stripe] that utilizes the SSL (Secure Socket Layer) protocol.
Other payment methods, e.g., PayPal, Apple Pay.

Article 7: Delivery

Deliveries are made to the address specified on the order form, which must be within the agreed geographical area. Delivery times are provided for information purposes only [3 to 5 business days].

Article 8: Right of Withdrawal (Exception for customized products)

In accordance with the provisions of Article L.221-28, 3° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts concerning the “supply of goods made to the consumer’s specifications or clearly personalized.”
Consequently, given the personalized and custom-made nature of the products sold on frenchyshapes.com, no order may be canceled, returned, exchanged, or refunded once its production has commenced.
The Customer is therefore advised to pay the utmost attention to the details of their order (texts, spelling, colors, dimensions, etc.) before proceeding with the final validation of their cart.
Exceptional cases: A return or replacement will only be accepted in the following cases (in accordance with Article 9 – Legal Warranties):
The received product presents a proven manufacturing defect.
An error was made by FrenchyShapes regarding the specifications validated during the order (e.g., spelling mistake on our part, wrong color manufactured).
The product was demonstrably damaged during transport (provided that reservations were expressed to the carrier upon delivery).
In any of these exceptional situations, the Customer must contact customer service at frenchyshapes@gmail.com within 3 days of receipt, providing supporting photographs, so that a solution (product replacement) may be offered.

Article 9: Legal Warranties

All products supplied by FrenchyShapes benefit from the legal warranty of conformity (Articles L. 217-4 and following of the French Consumer Code) and the warranty against hidden defects (Articles 1641 and following of the French Civil Code). In the event of non-conformity of a sold product, it may be returned, exchanged, or refunded.

Article 10: Intellectual Property

All elements of the frenchyshapes.com website (texts, images, logos, designs, videos, website architecture) are and remain the exclusive intellectual property of FrenchyShapes. No one is authorized to reproduce, exploit, or use in any capacity whatsoever, even partially, any elements of the website.

Article 11: Personal Data

FrenchyShapes commits to preserving the confidentiality of the information provided by the buyer, which they may be required to transmit for the use of certain services. Any information concerning them is subject to the provisions of Law No. 78-17 of January 6, 1978, as amended (French Data Protection Act) and the GDPR.
